1. Introduction & Acceptance

Welcome to Custora AI ("Custora," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Custora AI platform, including our website, applications, APIs, and all related services (collectively, the "Service"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

2. Service Description

Custora AI is an AI-powered video generation platform that enables users to create professional video content using advanced artificial intelligence models. The Service allows users to generate videos from text prompts, images, audio, and other inputs using AI technologies provided by third-party model providers including Kie.AI (Veo3), OpenAI, and Google Generative AI.

3. Account Registration

To use the Service, you must create an account using your email address or through an OAuth provider (such as Google). You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. You must be at least 13 years old to create an account and use the Service.

4. Subscription Plans & Billing

Custora AI offers the following subscription plans:

All paid subscriptions are billed through Stripe. Additional token packs may be purchased separately. Prices are subject to change with reasonable notice.

5. Token System

Video generation on Custora AI is powered by a token-based system. Each generation consumes a certain number of tokens depending on the model used, video duration, and resolution. Tokens do not roll over from one billing cycle to the next; unused tokens expire at the end of each billing period. Your token balance is refilled at the start of each new billing cycle according to your subscription plan.

6. Content & Intellectual Property

6.1 Your Content

You retain ownership of the content you generate using the Service, subject to the terms and usage policies of the underlying AI model providers. By using the Service, you grant Custora a non-exclusive, worldwide, royalty-free license to process, store, and transmit your content solely for the purpose of providing and improving the Service.

6.2 Custora's Intellectual Property

The Custora AI platform, including its design, features, code, trademarks, and documentation, is the intellectual property of Custora and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

7. Acceptable Use

You agree not to use the Service to:

• Generate, distribute, or promote illegal content
• Create content that promotes hate speech, violence, or discrimination
• Produce deepfakes or manipulated media intended for fraud, deception, or impersonation
• Infringe on the copyrights, trademarks, or intellectual property rights of others
• Abuse, overload, or interfere with the Service or its infrastructure
• Circumvent usage limits, token restrictions, or access controls
• Use the Service for unauthorized commercial redistribution of AI model outputs

Violation of this policy may result in immediate suspension or termination of your account without refund.

8. Watermarks

Videos generated on the Free plan may include a Custora watermark. Paid subscription plans (Starter, Pro, and Business) provide watermark-free video generation. Removing or tampering with watermarks on Free plan content is a violation of these Terms.

9. API Access

API access to the Custora AI platform is available exclusively on the Pro and Business subscription plans. API usage is subject to rate limits and the same acceptable use policies described in these Terms. API access credentials must be kept confidential and may not be shared with third parties.

10. Service Availability

We strive to maintain high availability of the Service, but it is provided on a best-effort basis. We do not guarantee any specific uptime percentage. The Service may be temporarily unavailable due to maintenance, updates, or factors beyond our control, including third-party AI model provider outages. We will make reasonable efforts to notify users of planned maintenance.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CUSTORA AI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO CUSTORA IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Termination

Either party may terminate this agreement at any time. You may terminate by deleting your account through the Service. We may suspend or terminate your access if you violate these Terms or engage in activity that could harm the Service or other users. Upon termination, your right to use the Service ceases immediately, and your account data (including generated content) will be deleted in accordance with our Privacy Policy.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Effective Date." Your continued use of the Service after changes are posted constitutes your acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction.
